Moatly LLC ("Moatly," "we," "us," or "our"), a limited liability company registered in the State of Wyoming, United States, is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Moatly mobile application ("App") or visit our website at getmoatly.com ("Website").
By using the App or Website, you agree to the practices described in this Policy. If you do not agree, please discontinue use of the App and Website.
2. Information We Collect
2.1 Information You Provide Directly
When you create an account or use the App, we collect your email address, first name, last name, and phone number. We also collect profile information including your self-identified areas of passion, talent, and financial interest (used to personalize your Meaning score and Circle of Competence), as well as your watchlist stocks, conviction check responses, and scenario modeling inputs.
2.2 Information Collected Automatically
When you use the App, we automatically collect usage data (features accessed, screens viewed, ticker searches, session duration), device information (device type, OS version, unique device identifiers, App version), subscription data (tier, status, history), and crash and performance data to help us improve the App.
2.3 AI Interaction Data
If you use MoatlyAI features (available on Investor + AI plan), your questions and conversations with MoatlyAI may be processed and temporarily stored to provide contextual responses. We also store records of which stocks you request AI analysis for and the insights generated.
2.4 Information from Third Parties
We receive subscription purchase confirmations, renewal events, and cancellation events from Apple and Google via RevenueCat. Financial data associated with tickers you search is sourced from third-party providers and is not linked to your personal identity.
3. How We Use Your Information
We use the information we collect to provide and manage your account and subscription, calculate your personalized 4M scores, deliver MoatlyAI insights, improve the App, communicate important account and subscription updates, detect fraud and unauthorized access, and comply with applicable legal obligations.
We do not use your personal information to make automated investment decisions on your behalf. All investment decisions remain solely yours.
4. How We Share Your Information
We do not sell your personal information. We share your information only in the limited circumstances described below.
4.1 Service Providers
We share information with trusted third-party service providers: Supabase for database, authentication, and storage; RevenueCat for subscription and purchase management; Financial Modeling Prep for financial data; and Anthropic for the AI model powering MoatlyAI. These providers are contractually obligated to use your information only as directed by us.
4.2 Legal Requirements
We may disclose your information if required to do so by law, court order, or governmental authority, or if we believe disclosure is necessary to protect our rights or the safety of others.
4.3 Business Transfers
If Moatly is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.
5. Data Retention
We retain account data until you delete your account. Usage and analytics data is retained for up to 24 months in identifiable form, then aggregated or deleted. AI conversation data is retained for up to 12 months to provide contextual responses. Subscription records are retained for up to 7 years for financial and legal compliance. After account deletion, we may retain anonymized, aggregated data that cannot be used to identify you.
6. Data Security
We implement industry-standard security measures including TLS/HTTPS encryption for data in transit, encrypted storage via Supabase, row-level security policies ensuring users can only access their own data, and regular security reviews. No method of transmission or storage is 100% secure. You are responsible for maintaining the security of your account credentials.
7. Your Rights and Choices
You may access and update your account information at any time through the App's Settings page. You may request deletion of your account and personal data by contacting us at info@getmoatly.com — we will process your request within 30 days. You may request a copy of your personal data in a portable format at any time. You may opt out of marketing emails via the unsubscribe link in any email. You may control push notifications through your device settings at any time.
8. California Residents — CCPA Rights
If you are a California resident, you have the right to know what personal information we collect about you, the right to delete your personal information, and the right to non-discrimination for exercising your rights. We do not sell your personal information — you do not need to opt out. To exercise your rights, contact us at info@getmoatly.com with the subject line "California Privacy Request." We will respond within 45 days.
9. European Users — GDPR Rights
If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the right to access, correct, delete, restrict, and port your personal data, and to object to processing. We process your data on the following legal bases: contract performance (to fulfill your subscription), legitimate interests (to improve the App and ensure security), consent (for optional communications), and legal obligation (to comply with applicable laws). 10. Children's Privacy

11. Financial Data Disclaimer
Moatly displays financial data sourced from third-party providers for informational and educational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any financial data. Nothing displayed in the App constitutes a buy or sell signal or a recommendation to purchase or dispose of any security. Financial data is not personalized financial advice.
12. AI and Automated Processing
MoatlyAI uses artificial intelligence to generate stock analysis insights and respond to investing questions. AI-generated content may contain errors or inaccuracies, does not constitute investment advice or buy/sell signals, and is for educational and informational purposes only. Conversations with MoatlyAI may be processed by Anthropic's AI systems, subject to Anthropic's privacy policy. We do not use your data to make automated decisions with legal or similarly significant effects on you.
13. International Data Transfers
Moatly is based in the State of Wyoming, United States. If you access the App from outside the United States, your information may be transferred to and processed in the United States where our servers and service providers are located. For EEA/UK users, we rely on Standard Contractual Clauses and other appropriate safeguards for international data transfers where required.
14. Apple and Google Specific Disclosures
In accordance with Apple App Store requirements, the App collects the following data linked to your identity: contact information (email, name), usage data, purchases (subscription information), and identifiers (user ID). Crash data and performance data are collected but not linked to your identity. In accordance with Google Play's Data Safety requirements, users may request data deletion at any time by contacting info@getmoatly.com.
15. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via in-app notification or email at least 7 days before changes take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Policy.
